BOOKING TERMS & CONDITIONS – 12 September 2024 @ 2130hrs
BOOKING YOUR ACTIVITY
1. All bookings are made with Seven Hills Outdoors.
2. In order to make a booking please book using the online booking enquiry form on www.sevenhillsoutdoors.co.uk.
3. A booking will not be confirmed by Seven Hills Outdoors until:
(a) Seven Hills Outdoors has received a completed medical declaration and consent form for you and / or all participants in your group; and
(b) payment has been received in full by either bank transfer or card payment; and
(c) Seven Hills Outdoors confirms your booking in writing.
4. By completing the online booking form, you are confirming that you have read and accepted these booking terms and conditions.
CHANGES TO YOUR BOOKING
4. If you wish to change an existing booking, we will aim to accommodate that change. If a change is possible, we will charge an amendment fee of £10 per booking to cover our administrative costs. Any request to change an existing booking must be confirmed in writing at least 72 hours before the original activity is due to commence.
CANCELLATION OF YOUR BOOKING - BY YOU
5. If you wish to cancel, you must inform us in writing/via email. Your cancellation date is the date on which we receive written instruction. The following cancellation fees will apply:
(a) Beyond 30 days before the activity date full refund less £10 per person administration costs;
(b) 30 - 15 days before start date: retention of 50% of total price;
(c) 14 or fewer days before start date: retention of 100% of total price.
CANCELLATION OF THE ACTIVITY - BY SEVEN HILLS OUTDOORS
6. We reserve the right to cancel any activity (before or during it, for an individual or group, depending on the circumstances) as follows:
(a) Where the weather or ground conditions are such that in the opinion of the Guide it is deemed that there is a risk to the health and safety of the participants and Guides involved in the activity;
(b) Where in the opinion of the Guide the participants are inadequately equipped for the activity, which exposes that individual or others within the group, to a risk to their health and safety.
(c) Where there have been disclosed or undisclosed medical conditions at the time of booking the activity or subsequently disclosed or undisclosed on the medical declaration and consent form provided after booking, which in the opinion of the Guide may impact the health and safety of the individual with the relevant medical condition or other members within the group;
(d) Where the behaviour of an individual is such that in the opinion of the Guide it exposes themselves or others in the group to a risk to their health and safety, is impacting the enjoyment of the activity by others in the group or is illegal;
(e) Where the activity requires a set number of participants and in the opinion of the Guide there are insufficient participants to make it financially viable;
(f) Where the individual or group fails to follow reasonable instructions from the Guide to ensure the health and safety of the group.
7. We will always look to modify/change the activity (e.g. date, location, high to low level guided walk etc) to accommodate or mitigate the circumstances identified in paragraph 6 (a-c) or (e) above. However, if an activity is likely to be cancelled under the circumstances identified above, we undertake to inform you as soon as possible. This may not always be possible before arrival at the start of the activity, for example, conditions on the ground may be very different to those forecast. See also paragraphs 8 – 10 below.
MODIFICATION/CHANGES TO YOUR BOOKING
8. On assessing the conditions expected to be encountered in the hills/mountains or the abilities of the team members, your Guide may decide to change any aspect of the activity, if he/ she believes that to continue with the activity would place anyone at undue risk.
9. We will inform you of such changes at the earliest opportunity, unfortunately there are circumstances when these changes will need to be made at the start of or during the activity itself. In the case of participation numbers, not less than 1 week before the activity (for group walks/ activities).
10. We will, in the circumstances identified in paragraph 6 (a - c) & (e) above, look to modify or change the activity as set out above. If that is not possible then we will cancel the activity.
CANCELLATION – GENERAL
11. In the event of cancellation we do not accept responsibility for any other costs incurred by you (e.g. transport, accommodation) linked to your booking.
12. We cannot be held responsible for any missed connecting transport that you have booked independently of Seven Hills Outdoors.
13. The Guide leading the activity will attempt to ensure that any problems are solved for the benefit of the group as a whole. Completing the online booking form confirms your acceptance of the Guide’s authority to make decisions affecting the group or individuals and to follow all reasonable instructions given by the Guide, for example, the guide may require an individual to leave the group if he/she reasonably believes:
(a) that person’s health is at risk (for example through non-disclosure of medical conditions); or
(b) they have inadequate fitness to complete the activity; or
(c) if an unlawful act is committed by them; or
(d) their behaviour becomes detrimental to the safety, enjoyment or wellbeing of the group.
14. Should the Guide take such action in paragraph 6 (b-d) and (f) or 13 (a-d), that person would not be entitled to any refund and the contract between Seven Hills Outdoors and that individual or individuals will be repudiated.
15. We will only modify, change or cancel an activity due to circumstances beyond our control as identified above and where possible provide reasonable notice.
REFUNDS
16. In the event of cancellation by Seven Hills Outdoors caused by ‘force majeure’ (examples of which include but are not limited to War, Riots, Civil Disturbances, Terrorist Activity or Consequences, Natural Disasters, Fire, Health Risks, Industrial Disputes, Actual or Potential Severe Weather Conditions and any other similar events beyond our control) participants will be notified by telephone, in writing or by e-mail as soon as practicable and the following options will be offered, where possible:
(a) an alternative activity on the same date;
(b) an alternative date for the same activity;
(c) an alternative date for an alternative activity equal to original monies paid.
(d) in the case of cancellation by Seven Hills Outdoors Limited for any other reason (not including force majeure, paragraph 6 (b-d) and paragraph 13 (a-d) a full refund or alternative booking shall be available.
COMPLAINTS
17. If you have any complaints whilst taking part in an activity, you must immediately inform your Guide who will use all reasonable efforts to remedy it. If you remain dissatisfied, you must make full details of the complaint known to us in writing within 28 days of the end of your activity.
18. We ask you to follow this process as the right to claim compensation you may otherwise have been entitled to may be effected or even lost as a result.
LIABILITY & PARTICIPATION IN OUTDOOR ACTVITIES WITH SEVEN HILLS OUTDOORS
19. Engaging in adventurous activities inherently involves risk. Mountainous and upland environments, while hazardous, offer opportunities for profound physical and mental benefits. Participants must acknowledge and accept responsibility for these risks. Seven Hills Outdoors believes that the rewards of experiencing these environments far surpass the associated dangers.
20. Seven Hills Outdoors nor any of their representatives will be responsible for any illness, injury or death sustained during your activity except where such illness, injury or death is caused by the negligence of Seven Hills Outdoors or that of Seven Hills Outdoors representatives, nor will Seven Hills Outdoors be liable for any uninsured loss of personal property.
21. Seven Hills Outdoors cannot be made liable for the consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences.
22. A client leaving an activity at any stage, for whatever reason, will not be entitled to any refund or compensation unless agreed by Seven Hills Outdoors and any duty of care that might be owed to that client will end at that point.
23. Having made every effort to ensure correctness of our information and supporting materials, Seven Hills Outdoors cannot be held responsible for any inaccuracies.
24. Seven Hills Outdoors shall ensure that appropriate security measures are in place to protect your personal data please see our privacy policy.
INSURANCE
25. We recommend that you hold relevant insurance for your activity to cover all eventualities such as; all cancellations, medical expenses, travel delays, search & rescue, equipment loss or theft and evacuation costs.
CONSENT TO USE IMAGES & VIDEOS
26. By agreeing to these booking conditions, you consent to
(a) the Seven Hills Outdoors and their representatives taking photographs and/or video footage of you during the activity and that these images may be used by Seven Hills Outdoors for publicity and training purposes including, but not limited to, in brochures, websites material and in the media unless you have ticked the box on the booking form. Photos and video footage supplied by you or other team members may also be used as described above, and
(b) that you have read and understood the Privacy Policy and GDPR Policy on our website
INTERPRETATION
27. Seven Hills Outdoors means Daniel Stowers trading as Seven Hills Outdoors.
28. Guide means the activity leader who will be a mountain leader, freelance mountain leader or freelance hill and moorland leader.
29. Activity means any booked Seven Hills Outdoors provided activity (e.g. guided runs, walks, guide hire or navigation course).
